Impath Bankruptcy Liquidating Trust The Impath Bankruptcy Liquidating Trust (“Liquidating Trust”) has been created pursuant to the provisions of the Third Amended Joint Plan of Liquidation Under Chapter 11 of the Bankruptcy Code, dated January 20, 2005 (as the same has been or may be amended, the “Plan”) filed in the United States Bankruptcy Court for the Southern District of New York (the “Court”) for IMPATH Inc. (“IMPATH”), IMPATH Physician Services, Inc., IMPATH Predictive Oncology, Inc., IMPATH Information Services, Inc., IMPATH-T, Inc. (f/k/a Tamtron Corporation), and IMPATH-M, Inc. (f/k/a Medical Registry Services, Inc.), as debtors and debtors in possession (collectively with IMPATH, the “Debtors”). The Plan was confirmed by the United States Bankruptcy Court for the Southern District of New York by Order entered on March 22, 2005 in In re IMPATH Inc., et al., Chapter 11 Case No. 03-16113 (PCB) (Jointly Administered). The Liquidating Trust has been created on behalf of, and for the sole benefit of, the holders of Allowed Securities Litigation Claims and Equity Interests as set forth in the plan. The Liquidating Trust was established for the purpose of liquidating and distributing the Debtors’ assets and for prosecuting certain of the Debtors’ claims and causes of action, in accordance with Treasury Regulation section 301.7701-4(d), with no objective to continue or engage in the conduct of a trade or business. Pursuant to the Plan, on the Effective Date, the Liquidating Trust will be established and Anthony H.N. Schnelling will become the trustee of the Liquidating Trust (the “Trustee”). IMPATH Inc. (OTC: IMPHQ) announced that July 22, 2005 will be the effective date (the “Effective Date”) of the Third Amended Joint Plan of Liquidation under Chapter 11 of the Bankruptcy Code (the “Plan”) of IMPATH Inc. and its debtor subsidiaries (the “Debtors”). |
